Article 48-General and special discharge hearings
48.1 General and special discharge hearings
A general discharge hearing is a hearing called to hear the citations and service of a police officer prior to their retirement. The purpose of a general discharge hearing is to set any recommendations, awards or special benefits deemed appropriate upon a loyal police officer who has served their society.
48.2 Special discharge hearings
A special discharge hearing is when a hearing is called upon a serious breach of the POlice Code and the conviction of any police officer of a level 3 or above criminal offence.
A special discharge hearing shall operate like a criminal hearing with a Police Judge, the rules of evidence and the right to a fair defense.
The result of a special discharge hearing is whether an officer is either honorably, or dishonorably discharged from the force.
An honorable discharge means the police officer is honored, in spite of their breach and/or crime with maintaining all awards, former rank, citations, pensions and benefits whereas a dishonorable discharge means the officer is stripped of all awards, honors, rank, pensions and benefits and their badge number shall never be used again by an serving police officer.
